A Jane Doe Number 14, during the times that she provided the massages, on one of those occasions she was asked her age and she told him that she was 18.¶
On a later visit, they were talking about Jane Doe Number 14’s upcoming birthday and Mr. Epstein inquired about her 18th birthday, and Jane Doe Number 14 acknowledged that that would be her upcoming birthday.¶
Epstein actually called her on that and said: So you are not really 18 yet? And they both kind of laughed about it. And so he knew that Jane Doe Number 14 was having her upcoming birthday.¶
Q Does your prior testimony and your testimony today cover the evidence supporting the allegations in Overt Acts 112 through 131?¶
A Yes. A review of the phone calls indicate telephonic contact between and Jane Doe Number 14 as well as and¶

Jane Doe Number 14.¶
A review of the carbon copy message pads recovered during the execution of the state search warrant revealed messages between Jane Doe Number 14 and Jeffrey Epstein’s Palm Beach residence.¶
I have one of those here and I will read it for the record, which is specifically Overt Act 126. It’s a message for on January 26, 2005, at 1:30 p.m. It’s from¶
It says, you know the number, in parentheses. And then it says, she is confirming for 5:30 p.m. And it was taken by one of Mr. Epstein’s house managers.¶
We also have the statement of Jane Doe Number 14, which as I summarized before the discussion of the age, and we also have supporting documentation to corroborate the statement such as petty cash receipts from one of the house managers where he is documented paying Jane Doe Number 14, as well as a Western Union transaction that occurred at Christmas where Mr. Epstein provided Jane Doe Number 14 with $200 as a Christmas present.¶

Q And referring to Count 19 is the evidence you just summarized the basis for the allegation that Jeffrey Epstein, and used a facility in interstate commerce to persuade, induce, and entice Jane Doe Number 14 to engage in prostitution and in a sexual activity for which a person can be charged with an offense?¶

Q How many telephone calls have you been able to document between John Doe Number 14 and?¶
A We have approximately 70 phone calls between and Jane Doe Number 14.¶

A Jane Doe Number 15 is a white female named She was born She attended High School. I have testified about her previously.¶
Q Is there anything that you want to clarify or add regarding your previous testimony?¶

Q Please remind the grand jury during what period did Jane Doe Number 15 have contact with Jeffrey Epstein.¶
A We have telephonic contact between and Jane Doe Number 15 starting on December of 2004 through October of 2005. We believe through statements that she went to Jeffrey Epstein’s residence earlier than that.¶
She stopped for a time period and then returned and that’s when we have the phone calls¶

Q Did the phone contact continue after she turned 18?¶
A Yes. As I mentioned, the phone calls continued to October of 2005 and she turned 18 in June.¶
Q Please summarize the sexual activity that she was involved with, with Jeffrey Epstein.¶
A Epstein requested Jane Doe Number 15 to pinch his nipples. Mr. Epstein would fondle and pinch Jane Doe Number 15’s nipples. Mr. Epstein also engaged in masturbation in front of Jane Doe Number 15.¶

allegations in Overt Acts 132 to 148 and Overt Act 175?¶
A Yes. A review of the phone records indicate telephonic contact between and Jane Doe Number 15 as well as and Jane Doe Number 15.¶
We also have the review of the carbon copy message pads that were recovered in the state search warrant, in the execution of the state search warrant, which revealed the message from to Epstein, and I have that.¶
Specifically Overt Act 175, and it’s for Jeffrey Epstein. The date is October 1, 2005, at 9:50 a.m. The message is from and the message reads, confirmed at 11:00 a.m. and at 4 p.m. And is it signed by one of Mr. Epstein’s house managers.¶
We also have reviewed the evidence which was obtained in a trash pull that was conducted at Mr. Epstein’s residence by the Palm Beach Police Department in April of 2005 where a piece of paper was recovered in the trash, which is Overt Act 147.¶
It reads, 10:30, on Friday around 2:00. And then there’s a 3¶

underneath it on Mr. Epstein’s stationery. We have the statements from Jane Doe Number 15 as well as other witnesses.¶
Q Now with respect to Mr. Epstein’s knowledge of Jane Doe Number 15’s age, have you testified about that previously?¶
A Yes, I have.¶
Q And let me hand you two transcripts. One is of your testimony on March 20, 2007, and the second is May 15, 2007. If you would just read those for the grand jury.¶
A The first one from Tuesday, March 20, 2007, on page 17, starting on line 4.¶

Answer. Mr. Epstein asked her questions about herself, asked her if she was a soccer player or that — Jeffrey knew that she was a soccer player and asked questions about her college, about where she was going to school. It is currently going to Lynn¶

A Jane Doe Number 16 brought Jane Doe Number 17 to Mr. Epstein’s residence. They went, as I mentioned earlier, only twice did Jane Doe Number 17 go. Jane Doe Number 16 went much more than that.¶
But Jane Doe Number 17 was taken there twice by Jane Doe Number 16. Jane Doe Number 16¶

After a while during the massage, Mr. Epstein requested that Jane Doe Number 16 wait downstairs. Jane Doe Number 16 got dressed and left. Jane Doe Number 17 continued the massage.¶
Mr. Epstein began to masturbate. Mr. Epstein paid Jane Doe Number 17, $200. Jane Doe Number 17 stated that Jane Doe Number 16 had also received money for that day. Jane Doe Number 17 went back to Mr. Epstein’s house approximately a month later.¶
This time Mr. Epstein requested that Jane Doe Number 17 perform the massage completely nude. He used a vibrator on Jane Doe Number 17’s vagina and masturbated until he ejaculated and then the massage was over.¶
Q How much was Jane Doe Number 17 paid? A She was paid $200. Q And you mentioned that she was 16 during the time of these massages? A Yes. Q Did Jane Doe Number 17 recruit anyone to go to Jeffrey Epstein’s house? A No.¶

Specifically Overt Act 175 and Overt Act 178, and I will get those and read those. Overt Act 175 is what I read previously regarding Jane Doe Number 15, but I will read it again.¶
It is for Jeffrey Epstein, dated October 1st, 2005, at 9:50 a.m. The message is from [black text]. The message says, [black text] confirmed at 11 a.m. and [black text] 4 p.m. It’s signed by a house manager of Mr. Epstein’s.¶
Overt Act 178 is a message for Jeffrey Epstein, dated 10-2-2005. The time is 9:05 p.m. I’m sorry. Strike that.¶
It’s a message for Jeffrey Epstein, dated October 3rd, 2005, at 4:10 p.m. The message is for [black text] and the message is, [black text] will be a half hour late. It’s signed by Mr. Epstein’s house manager.¶

The only other thing I’d like to say is that we did obtain through the trash pull that the Palm Beach Police Department conducted in April of 2005, there was a computer printout of messages for Mr. Epstein which showed us a message from which read, can work tomorrow at 4 p.m. This is listed as Overt Act 162, and then we also have the statements of both Jane Doe Numbers 16 and 17.¶

Mr. Epstein took them from the kitchen upstairs to his master bedroom to where the bathroom was where the massages were performed. Both and Jane Doe Number Seven began massaging Mr. Epstein.¶
At Mr. Epstein’s direction, left the room after some time. Jane Doe Number Seven continued the massage. Jane Doe Number Seven was¶

The massage turned sexual where at this point Mr. Epstein was touching Jane Doe Number Seven’s mouth but on the outside of her underwear.¶
Mr. Epstein masturbated and then the massage was over. Mr. Epstein paid Jane Doe Number Seven, $200, and Mr. Epstein told Jane Doe Number Seven that if she told anybody what had occurred that bad things could happen to her.¶
Jane Doe Number Seven went to Mr. Epstein’s house approximately two or three more times after that.¶
Q And how was contact made with Jane Doe Number Seven?¶
A would telephone Jane Doe Number Seven.¶

During the massage, Jane Doe Number Eight was wearing a sports bra, a skirt, and thong underwear. The massage turned sexual. Mr. Epstein masturbated until he ejaculated.¶
Prior to that, Mr. Epstein moved Jane Doe Number Eight’s underwear to the side and rubbed her vagina. Approximately one week later, telephoned Jane Doe Number Eight and invited her to return.¶
Told Jane Doe Number Eight that Mr. Epstein would pay her if she brought a friend.¶
Q How much was Jane Doe Number Eight paid?¶

A Mr. Epstein paid Jane Doe Number Eight two or $300. She could not recall exactly. Tatum was also paid $200 for bringing Jane Doe Number Eight, and Tatum also told Jane Doe Number Eight that if she brought someone she would be paid $200.¶
Q Now you mentioned that there was telephone contact directly with Jane Doe Number Eight after that first visit. Approximately how many times did Jane Doe Number Eight go to Mr. Epstein’s house?¶
A Just that time.¶
Q And in addition to stroking her was there any other specific sexual activity that she was involved with, with Mr. Epstein?¶
A As I think I mentioned, he masturbated in the presence of Jane Doe Number Eight. Mr. Epstein fondled Jane Doe Number Eight’s bottom and pulled Jane Doe Number Eight’s underwear to the side and stroked her at that time.¶
Q Now you said that Jeffrey Epstein told Jane Doe Number Eight that she would get paid if she brought other people. Did she bring anyone else?¶
A No.¶

A Yes. The only other thing I’d like to mention is that there are approximately nine calls between and Jane Doe Number Eight, and Jane Doe Number Eight stated that would continue to call her to try to get her to come.¶
Q How did that phone contact end?¶
A I would like to refer to my notes.¶

A Jane Doe Number Eight told that she had moved out of the state to get to stop calling and that’s how the phone contact ended.¶
Q And could you just review Overt Act Number 59, which refers to a written telephone message?¶
A Overt Act 59 refers to the message pads that were recovered during the execution of the state search warrant. Overt Act 59 is a message that is written out for Mr. Epstein, dated July 17, 2004, at 6:55.¶
It looks like there is a mark through a.m. So I’m not sure if it’s 6:55 a.m. I believe¶

We are still checking on that. Jane Doe Number Seven during her interview she told us that when she went to Mr. Epstein’s house, she would take that we are aware of with Jane Doe Number Seven.¶
Q And with respect to Jane Doe Number 16 was she able to tell you when she was in comparison to the time that she was spending with Mr. Epstein?¶
A I know that when we interviewed Jane Doe Number 16, she told us that he was not aware of her problem. So I would like to go back and re-read that interview before I make that comment.¶
Q Okay. But with respect to all of the girls, including the two that you just spoke about have you been able to independently corroborate their statements?¶
A Yes, I have, and specifically with those two girls, Jane Doe Number 16, we have the telephone records. We have the message pads. We have the trash pulls. We have the statements from the other Jane Does.¶
It’s much the same with Jane Doe Number Seven through the statements of and other Jane Does, message pads, the telephone phone¶

A No. This specific Jane Doe, she was upset. She thought she was going there to model lingerie or perform a massage. When it turned into more than that, she was upset by that.¶

A When they did their search warrant at Mr. Epstein’s residence, some message pads were obtained at his residence, and they had several calls from a girl named and phone numbers. So they were able to track back those messages back to¶

Q How old did Miss tell you she was at that time?¶
A She stated she was 16 when she first started giving Mr. Epstein massages.¶
Q Based upon your review of the evidence, is that correct?¶
A No. We have phone records where (phonetic), Mr. Epstein’s assistant, is contacting on her cell phone, or using her cell phone to call cell phone starting in April of 2004, which makes 15.¶
Q So she said that she was 16, but your evidence shows that she was 15, and she said that she was told she could make a few bucks giving a topless massage?¶

A That she went to Mr. Epstein’s residence, that took her there the first time, that when she went upstairs she was paid $200 when she first got there by Sara Kellin. Then she goes upstairs, and Mr. Epstein comes in, he disrobes, puts on a towel, lays down on the massage table and she begins to massage him.¶
She tells Epstein that she heard he likes topless massages, and he told her that he did. And she said, “Who wouldn’t?” And she ended up taking off her top during the first massage. But is clear that Mr. Epstein did not at any point touch her during the massage.¶
Q But does she admit that he touched himself?¶
A Yes. On the second massage, Mr. Epstein asked her to leave her phone number with Her phone number was left there. On the second massage, she returned the very next day and gave him another massage. This time, Mr. Epstein masturbated in front of her.¶
Q Did Miss admit that he masturbated on more than one occasion in her presence?¶
A Yes, masturbated. And I think her term was that he “released,” meaning that he ejaculated.¶
Q How long of a period of time did Miss tell you that she performed massages?¶
A She wasn’t able to give us a number of massages,¶

Q You mentioned to the grand jury that Miss said that Mr. Epstein never touched her, correct?¶

Q Were there other things that she was adamant about in her interview with you?¶
A Well, she talked about what she would tell the girls that — and that she told Mr. Epstein that she was 18. I’m sorry, I take that back. She was told to say that she was 18, and she told us that she had a fake I.D. showing that she was 18.¶
So she passed that information along to the other girls when she brought — eventually she brought other girls to perform massages, and that was one of the things that she told — she told us first that she brought 18- to 20-year old girls. And then she stated that if the girls lied, and they were underage, she told them that they needed to tell Epstein that they were 18.¶
Q Have you been able to identify some of the girls that Miss brought to Mr. Epstein’s home?¶

Q So she was adamant that the calls only happened when she was already here?¶

Q. Were you made aware that Epstein’s counsel was informed that he was being investigated for traveling to engage in prostitution, which means that the appointments would have been made before the traveling?¶
A Yes.¶
Q Was there anything else, besides the issue of age and the issue of when the appointments were made, that sounded coached or that she was especially adamant about?¶
A No, I wouldn’t say coached. I mean, we talked about the preferences that Jeffrey discussed, as far as which girls he would like to bring.¶

told us that he liked different faces, so he would ask her to bring other girls. We asked her if he ever gave any preferences of what he preferred, and her response was that Epstein liked girls like her, which is thin and blond and attractive.¶
Q And how old was she at the time?¶
A She was 15.¶
Q So thin, blonde, attractive and —¶
A Young, girls like her. I guess we asked if she ever made a mistake, or ever brought somebody that Mr. Epstein didn’t take to. She said that she had screwed up and that she had brought a black girl to Mr. Epstein, and that Epstein was not interested in black girls. But he did pay her, and said that he wasn’t a racist. He paid her the $200 for her time, but did not want her to perform a massage for him.¶
Q And he didn’t allow that girl to perform a massage?¶
A NO.¶
Q Was there anything else that Miss talked about in the interview that you want to share with the grand jury?¶
A I did ask her at the end of the interview if she was in love with Mr. Epstein. She looked into the camera and said that she loved him like a friend. But then she¶

- kind of looked into the camera and gave a wink and a smile and said, “But with your money, I’d marry you any time, Jeffrey.”
Q Did she also say that she considered him to be an “awesome guy”?¶
A Several times she referred to him as an “awesome guy”. She said that the girls begged her to come and that the girls didn’t have a complaint, and the girls would share with her everything that happened after the massage, and that Jeffrey never touched any of the girls. But as I informed you, we did interview some of the girls that she took, and he has touched them.¶
Q In preparation for your testimony today, did you also speak with someone who is considered to be an expert in these cases?¶
A Yes.¶
Q Has Mr. been qualified to testify as an expert in federal and state courts in cases that involve what he calls “compliant victims”?¶
Q What does he mean by the term “compliant victims”?¶

necessarily forced into the conduct that the offender wants them to engage into, that they actually consent to that kind of activity.¶
Q So that would include minors who are subjected to sexual activity but weren’t necessarily kidnapped or forced at gunpoint, or something like that?¶
A Exactly.¶
Q Did he discuss with you the difficulties that exist when you interview those types of victims?¶
A Yes. He stated that a compliant victim is often times embarrassed that they went along with the behavior. They are also likely to deny the behavior, especially when being interviewed by investigators, that they’ll deny it or they’ll minimize it. Sometimes it takes two, three or multiple interviews to get compliant victims to either trust their interviewer or realize that their interviewer is not going to be judgemental.¶
Q In this case, have you found that to be the case with some of the interviews?¶
A Yes, I have.¶
Q In addition to being embarrassed, sometimes these victims feel guilty about the fact that they were involved in this type of activity?¶

A Yes, he does.¶
Q Did he explain why an offender would select the types of victims that are involved in this case, girls between 14 and 17-years-old?¶
A This type of offender, the sexual preference he has is for post-pubescent females that are physically developed but not necessarily mentally matured. The girls ranging in this age are sometimes inexperienced, they are possibly naive, not as worldly.¶
An offender of this type could also maybe not feel sexually adequate or feel competent dealing with his own age group. So knowing that these girls are less experienced, may focus on them as well.¶
Q In addition to their emotional immaturity, did Mr. Lanning talk about whether or not younger girls are easier to manipulate than grown women?¶
A Yes.¶
Q Did he talk to you about “grooming”?¶
A Yeah. That’s what an offender will use with a compliant victim. He told us that grooming is a technique where you gain the cooperation of those victims by focusing on their interests and playing up to those interests. It’s a type of seduction, he called it. That was his words for it. And we actually see this in this¶

case.¶
Q Can you give us an example of some of the types of grooming that Mr. Epstein used?¶
A With one of the girls we’re going to talk about today, it’s very apparent interviewing her how Epstein groomed her. She only went to three or four massages at this time, that she’s admitted to. We feel that due to her phone conversations, the multiple calls, that there may be more there. At this point she has stated to us that she has performed three or four massages for Mr. Epstein.¶
What he did is when she first went there he played upon — she was very shy, and he would play upon that shyness. He told her that she was pretty. He asked her to remove her clothing, and she would not. So he kind of kidded around with her shyness and complimented her, showed interest in her, talked about her boyfriend and different interests she had.¶
At the end of that interview, because she did not take off her clothes, he tells her that if she’s willing to do more, she will make more. He also tells her that he would pay her if she would bring other girls. As the massages increased, you can see that the next time she comes he plays again to that shyness, but he gets a little bit more — I guess he sees that it’s not working. This¶

time she does comply and takes off her — he asked her to disrobe on the second massage. She takes off her blouse, but she refuses to take off the bra after Mr. Epstein asked her to.¶
So you can see that he tries through showing interest. And then he actually — when he sees that this isn’t working, he takes a more authoritative role with her in the last massage. She said that throughout all of these massages he was very nice, and then at the end he was much more frustrated and irritated. She does get down to her bra and panties on that one, he’s just much more authoritative.¶
So he started with the grooming process, tried to get her interest, tried to use that to get her to comply with removing her clothes. But as often happens, at the end of this, he took over and was much more forceful with his requests.¶
Q Have other girls described that same situation where every time they went back, he tried to push it one step further and one step further?¶
A Yes. Several of the girls have said that he would always push for more and more.¶
Q Did Mr. Lanning explain why it is that a compliant child victim cannot legally consent to the sexual conduct?¶

A Yeah. He stated that — you know, we talked about how the law protects children, and stated that we hold adults accountable. When it comes to adolescents, they go through normal tendencies that mature offenders may try to take advantage of. But the law is in place for that reason, to protect — in the federal law, to protect those individuals under the age of 18.¶
Q And that’s because of the different maturity levels of the —¶
A The offender versus the victims, exactly.¶
Q Did you put together the photographs of the defendants in this case?¶
A Yes, I did.¶
Q Are these photographs of the four human defendants who are named in the proposed indictment?¶

Q And you mentioned that he is the president and the sole director. Is he also the sole shareholder?¶
A Yes, he is.¶
Q Are you familiar with Hyperion Air, Inc.?¶
A Yes. Hyperion Air, Inc. is also a business owned by Mr. Epstein. He is also the president, the director and the sole shareholder of that company as well. That company solely does business with his other aircraft, which is a Gulf Stream G-1159B. It bears a tail number N909JE.¶
Q Is that a smaller aircraft than the Boeing?¶

there on Epstein’s personalized stationary. On it it said, “with on Saturday at 10:30, and on Saturday with at 10:30.” That’s the exact message on the two notes that were found in his trash when they retrieved it on April 8.¶
Q . If I could direct your attention to Count Number Five, which appears on page 26. That is the charge of enticement of a minor, referring to Jane Doe Number 1, and Mr. Epstein and Miss are charged.¶
I know that you talked about the telephone traffic. The calls between and did they fall within that March 7 through March 11 time period?¶
A A review of their telephone records do indicate that there were phone calls made during that time.¶
Q And Jane Doe Number 1 actually went to Mr. Epstein’s home?¶
A Yes, and performed a massage for him in the nude.¶
Q And she was paid for that?¶
A Yes, she was paid $200.¶
Q And he masturbated in front of her, correct?¶
A Yes, he did. I would like to include that Sara Kellin took upstairs for that massage, and she also set up the massage table and arranged the oil and lotions¶

set up and arrange appointments for Mr. Epstein to have his massages.¶
Pertaining to, during the massage that occurred on those dates, February 6, in particular, I think I have discussed with you before what occurred on that, that he fingered — and that was his term for it — and that he used a massager on her.¶
He did masturbate during that massage, and she believed he ejaculated because he wiped off his penis with a towel. She was paid $300, and we know that she was 14 at the time.¶
Q If we could turn to Count Number 43, which appears on page 31. Count 43 is one of the travel counts. If you could tell the grand jury, did a trip occur on March 31, 2005?¶
A Yes, we have flight records that indicate a flight occurred on that date.¶
Q What type of plane was used?¶
A I’m going to refer to the J.E.G.E., Incorporated aircraft as just the Boeing 727. If we talk about the Hyperion Air, Incorporated aircraft, which is the Gulf Stream, I will just say the Gulf Stream. So on that date he did travel on his Boeing 727, on 3-31.¶
Q And Mr. Epstein was aboard the plane on that day?¶

Q With respect to the March 31st trip, was there evidence of him setting up the appointment with prior to that trip?¶

A Additional subpoenas that have been issued include OLY-28 to Colonial Bank, along with OLY-29, which was issued to Palm Beach National Bank & Trust Company. That was served on March 5, 2007. It should be known that Palm Beach National Bank & Trust Company is now operated by Colonial Bank, which we learned in the issuance process. We did receive documents back from Colonial Bank, which covered both subpoenas, on April 25, 2007.¶
Q And those sought information relating to bank accounts belonging to Mr. Epstein?¶
A That is correct.¶
Q What else?¶
A Also served OLY-30 to Western Union Financial Services seeking documents and records related to Jeffrey Epstein. It was served on February 26, 2007, and we received items back from Western Union on two separate dates, and two packages, the first on April 9, 2007, and the second on April 11, 2007.¶
Q And those sought records of wire transfers from Mr. Epstein to girls whom have been identified for this investigation?¶
A Yes.¶
Q What else?¶
A We also served OLY-31 to Western Union Financial Services. It was served on February 26, 2007, and they¶

returned information which we received on May 3, 2007.¶
Q The same type of information?¶
A Yes, the same type of information, seeking wire transfer information from Jeffrey Epstein to victims.¶
We also served OLY-32 to J.P. Morgan Chase Bank. After serving that one on February 26, 2007, they informed us by letter that they are known as Chase, not J.P. Morgan Chase. So we had to reissue another subpoena, which was taken care of on March 22, ‘07.¶
We also issued OLY-40 on Chase Bank as well on April 4, 2007. We received records on April 13, 2007 and April 19, 2007 to cover all three subpoenas that were served.¶
Q And those sought information related to bank accounts and credit cards related to the defendants?¶
A Yes. Additionally, we served OLY-33 on Dr. Thomas Rofranno (phonetic), who’s a chiropractic doctor. We were seeking records related to Jeffrey Epstein as a patient. The subpoena was served on March 6, 2007, and Thomas Rofranno provided materials on March 16, 2007.¶
Also we have OLY-36, which was served on the Palm Beach County Health Department. It was served on March 5, 2007, seeking birth certificates of our victims that we were researching. We received the records from the Palm Beach County Health Department on April 16, 2007¶

We also served two subpoenas on the Adult Video Warehouse. The first one was OLY-41, which was served — both of these were served on April 24, 2007, and they were seeking any transactions that had occurred on behalf of Mr. Epstein or those individuals that were working for him or with him. We received items back on the OLY-41 subpoena on April 30, 2007.¶
The second subpoena served on Adult Video Warehouse was OLY-34. Again, it was served on April 24, 2007, and the Adult Video Warehouse complied and provided us materials on April 30, 2007.¶
That concludes all of the items that we have received to date for the outstanding subpoenas that were issued.¶
