The above referenced individual has committed an offense in another jurisdiction and has established residence in New York State at the address indicated. It has been determined that the offender is required to register and be risk assessed as a sex offender in New York State.¶
The NYS Board of Examiners of Sex Offenders is recommending a risk level and designation for the offender, as indicated on the attached risk assessment instrument, case summary and designation form. Pursuant to Correction Law Section 168-k(2), the County or Supreme Court in the county of residence of the offender shall determine the offender’s risk and designation. The Court must determine whether the offender meets the definition of sexually Violent Offender predicate sex offender or sexual predator as set forth in Correction Law Section 168-a(7).¶
