An “attorney for the government” did not confer with Jane Doe #1 or Jane Doe #2 about the specific terms of the Non-Prosecution Agreement prior to:

(a) its execution on September 24, 2007;

(b) the execution of the Addendum to the Non-Prosecution Agreement on October 29, 2007; and

(c) the commencement of the performance of the Non-Prosecution Agreement on June 30,2008.
