It says, “The United States Department of Justice, Office of the Inspector General Warnings and Assurances to Employee Requested to Provide Information on a Voluntary Basis. You are being asked to provide information as part of an investigation being conducted by the Office of the Inspector General. This investigation is being conducted

pursuant to the Inspector General Act of 1978, as amended. This investigation pertains to security failure and job performance failure. This is a voluntary interview. Accordingly, you do not have to answer questions. No disciplinary action will be taken against you if you choose not to answer questions. Any statement you furnish may be used as evidence in any future criminal proceedings or agency disciplinary proceeding or both.” And there’s a waiver section. It says, “I understand the warnings and assurances stated above and I am willing to make a statement and answer questions. MR. Through, again, Psychology recommends, “Oh, they’re about the same age.
They both are pretty much have -” - not similar charges, but, “This guy is an older man. This guy has a cane. There’s not going to be any problems, we should put them in together.”
MR. Are you aware of anything like the Captain and the Warden and even the Regional Director going through and vetting Epstein’s cell mates or are you unaware of that?
MR. No.
MR. All right. So, you’re understanding was that Psychology made that determination?
MR. Correct.

MR. No, no, no. So would it be when the other court people, inmates return or would it be prior to that? So, yes, you said, he’s likely not coming back at approximately 8:38 when you bring him down. He leaves, it’s kind of assumed that he’s not coming back. We’re trying to figure out, when is it known he’s definitely not coming back.
Is that when the other inmates that went to court are returned to the MCC or they return at different times or how does that work?
MR. Well, the inmates, they don’t all return together. They return different times.
MR. Z: Okay.
MR. But, that’s actually a good question. I want to find that out too. I

MR.: -- record keeping. Were you ever instructed on what action should be taken if Reyes, who was assigned to Epstein as a cell mate, was removed from the institution?
MR. If anybody, not only Epstein, loses a bunkie, and he was already on suicide watch, then that’s pretty much our training. If he returned from suicide watch, he needs a bunkie. If he has a bunkie and the bunkie leaves, we get him another one.
MR. Z: Okay. Okay, so in this case then, it was Reyes was likely to have been removed from the institution. What actions should have been taken to replace Reyes and when should have they been taken?
MR. A: Well, as soon as it was verified or confirmed that he left the

building, and Epstein was coming up from his attorney visit, which was probably around 8:00 because that’s the last, like the last call on attorney conference, last legal visit has to be out of the legal department by 8 o'clock. So, as soon as we find out that - if Reyes wasn’t there for the 4 o'clock count, it should have been, “Okay, let’s find Epstein another bunkie so by the time he comes upstairs, he has one already.”

So at 4:00 p.m., they should have been making some notifications or at least requesting information on Reyes’s location, correct?
MR. Correct.
MR. By 8:00 p.m., when Epstein returned from attorney conference, you’re saying at least by that time, that’s when a new cell mate should have been assigned or -.
MR. correct.
MR. Okay. And who was responsible for assigning Epstein with a new cell mate?
MR. So, anyone in SHU could do it. Just got to make sure he doesn’t have any separations from another inmate. But, Epstein, when he came to the building was a big deal to everybody, so everybody wants to be involved.
So I think they should just notify whoever it was, the Lieutenant, and let the Lieutenant ask around or speak to Psychology who you recommend to be his bunkie.
MR. Okay. And so, being that Epstein was a big deal and people wanted to be

which the rounds sheets we still have, that's the actual paper you write it in.
MR. Do they - have they done both? Do you not only have this paper that I just showed you there with the rounds, do they also have - do you also have to go into TRUSCOPE and log them in manually as well?
MR. Yes. But not the every 30 minute rounds. Like, in the unit, you document your rounds. In SHU, you have to do it on the paper, you don't have to write on TRUSCOPE, "I did a round 30 minutes, I did a round within 40 minutes, I did a round in 30 minutes." You don't have to write it over and over and over on TRUSCOPE.
MR. When do you have to do it in TRUSCOPE?
MR. Just throughout your shift that you conducted rounds.
MR. So it's not every 30 minutes but at some point you've got to go in?
MR. Yes.
MR. And do you have to document, like within TRUSCOPE that you did it every 30 minutes or just that it - how does

MR. No. You have to - by policy, do a round throughout the whole building and make sure you log it in. And in SHU, we have the round sheets which that’s part of your SHU round. You can’t just walk into SHU, do a 360 and walk right back out. You have to sign the round sheets.
MR. And what’s your opinion if Lieutenants are telling us, “No, no, no, no,

MR. All right. So this is where it’s going to get a little complicated, so just bear with me. I’m going to show you these count slips from August 9th up until midnight of August 10th. I’m just going to have you help - this is where, remember, I said I was going to help you, you know, put this puzzle together. Believe we already know the answers but I don’t want to give you the answers in fear that I’m wrong. So this is from the 5:00 a.m. count to the midnight count and I want to show you the Lieutenant’s log which, where is that? So here's the Lieutenant’s log. And we didn’t print out that paper that I made, did I?
MR. Which one?
MR. The one that I drafted yesterday and said, “Make sure we print this out.” All right, so, we’ll just start with 8:00 a.m., since that’s when you came in, so we can actually - the reason I was showing you the 5:00 a.m. is because I really wanted you to notice - okay, two. Is ZA the SHU?
MR. Yes.

going to start getting interested. So at midnight, the ZA count says, "72." "72," right? So the count slip says, "73." Now, reviewing this, the E-1 says, "72," same institutional count, says, "72," the count slip still says, "73." Now let’s look at this. And granted, you just told us this could have been done later in the day so maybe this wasn’t done at the time.

MR. So does that tell you that they did or did not conduct the count in the SHU?
MR. If they counted 75 physical bodies, then that’s a good count.

MR. But now, if there is not 75 physical bodies in the SHU, then they went off whatever it is they were going off and verified it with this paper right here, which not everybody has access to it. This is the E-1 that we keep count on.
MR. So would the SHU people that are in the SHU, would they have access to know what the count was for this E-1, what they’re utilizing for that count?
MR. No. Unless somebody says, “Hey, you’re missing one, your count is 75.”
MR. So the only way someone in the SHU would be able to actually know what number to provide is by actually doing the count?
MR. Correct.

if we know that Fernandez is now not in the SHU, how are they coming up with that 75 number and for 4:00 p.m. and then as well as 10:00 p.m., they're coming up with a wrong number and again at midnight, they're writing down the wrong number. They're writing down the number that they think the institutional count is, but there's not that many people that are actually in SHU. How do we explain that?
MR. So, the only thing I can think of is they put - they locked somebody up between the 4 o'clock count and the 10 o'clock count meaning somebody from the unit did something wrong and they ended up in the Special Housing Unit. So that's how the numbers would be different.
MR. So if we have information that -.

MR. Again, everybody is human and everybody makes mistakes, unless somebody write in the log missed one inmate going from a unit out or leaving from SHU to a unit.

MR. Because we’ve also been told at least by one of these people that they write the count slips before ever doing the count. So how would they know what number to put in the count slips if they didn’t actually do the count?
MR. : So they shouldn’t and my other explanation is they actually did have the bodies, but one of them was in SHU and was never written on the log. So now, there’s this other thing called a PB-38 that shows who goes

That would actually help you because it would - that's our little cheat sheet, like I told you before, that we log in during the day or right before I get relieved at 2 o'clock, I'm going to print out that PB-38, it's going to show me every inmate movement in the building and whatever specific date I want it. So if I'm doing today, three from SHU just saying, "Left to another institution, to Brooklyn." On that PB-38, it would say, "Jones, Smith, Roberts moved to Brooklyn." So now, I go that, I have 757, I just lost three. Now I'm going down to 754. And just like it is here, inmate 123 left to Brooklyn so now my numbers go down. Again, we're all human, sometimes there's a lot of movement, we might miss one or two. So this right here -.
MR. But if these numbers appear to all add up starting the day at 77 --
MR. Correct.

a. m., then I can show you all the way through after Epstein, you know, die where I’m assuming they definitely did the counts because there’s a - here’s one that was done at 11:00 a.m., I guess that was the 10:00 a.m. count on Saturday

MR. I think they were conducted wrong. If the names - the only way I would actually confirm it is the 38. Because an inmate could be in SHU, he’s already keyed in SHU. Maybe he’s on staff watch, it’s still in

If you’re doing a stand up count which every count is a stand up count, you stand at the door, acknowledge your presence, stand up count, okay, Johnson is standing up, Smith is standing up, that’s two. I go all the way around, I do that to every single cell, the eight cells. By the time I get to the end, I counted 15, I write 15. Then the next person behind me has to do the same exact thing. MR. Right. And when we read this for this Fernandez on dry cell with staff watching R&D, is it possible that Fernandez was in SHU dry watch and then later in the day moved to R&D dry watch?
MR. He could have went from a unit into dry watch or Special Housing, SHU, to dry watch.
MR. How does that typically work? If you’re on dry watch, is there a reason for them to bring you from the SHU on dry watch to R&D on dry watch or would it typically just go right from the SHU to dry watch in R&D?

MR. Yes, because there was only two officers and one on morning watch.

MR. Then you’re supposed to have four officers in SHU during the day. If it would have been three, then removing one officer would have left it with just two officers in SHU. So if you have just three officers and I’m going to put, for example, Officer to do dry watch and I’m sitting there and I cannot move, I have to watch this inmate throughout the whole day.
MR. So with that being said, do you believe it’s more likely than not that he was moved to the dry cell in R&D at through, whatever time we said it was, 3:15?
MR. It could have been.

MR. See, that happened four years in and I was just working the SHU for about almost, I would say, six months. So from - again, when I started working in the SHU, it was six of us throughout during the day. By the time I got out of SHU, it was three of us. So when I - it’s human nature, people get lazy, but the whole time that I was there, I didn’t hear about, “Oh, this guy is going to write the rounds,” or, “This guy is going to count,” and just give in the slips. So, again, I was pretty new in SHU. I’ve always worked the unit and when I counted the unit, I had to count with somebody.
MR. : Did anyone ever, since you were new to the unit, ever tell you, "Oh, this is the way we do it in SHU, we don't actually do counts."

Ever leading up to the 9th, so any day leading up to the 9th, would have you had a conversation with them to say, “Make sure you’re doing your rounds and counts correctly.”
MR. A: Yep. I’m sure I’ve told them - because everybody wants to work SHU.
SHU is a pain in the butt, but, if you want to work SHU, you got to do your rounds and do your stuff how you’re supposed to do it.

MR. The system is kind of a pain in the butt because you’ve got to do one by one by one, you know, unless you do all of them. I mean, unless you do one, then enter, then another one and enter. It’s not like you could do multiple cell searches or click them that you did them at one time.

No, not really. Like I said, sometimes the lights go off in the tier and we got to reset the breaker, so ever since I started, there’s always been a problem with something not working in this building. So the camera doesn’t surprise me, it’s just another thing that didn’t work for the moment.
MR. : So this is where like, it’s just like, what are your - what is your opinion on the fact that we got no cameras working on at least, you know, definitely on Epstein’s tier, he’s in the wrong cell, you know, we could always - you know, the counts are basically, you know, potentially falsified, the counts weren’t done. Is there anything that you’re seeing here that you’re like,
“Somebody is covering up for somebody,” or,
“Somebody is like manipulating things or deleting cameras or taking anything down?” Is there a reason for you to believe any of that?
