You are being asked to provide information as part of an investigation being conducted by the Office of the Inspector General. This investigation is being conducted pursuant to the Inspector General Act of 1978 as amended. This investigation pertains to job performance failure and security failure. I’m writing that in here.
MR. And that doesn’t mean your job performance failure. That means that’s what the investigation is involving.

Anything communication-wise. If anybody’s having a problem, they usually get to me. Even something as simple as a voice mail. They’ll say hey my machine isn’t working and I go take a look at it. And where somebody’s computer is not working. So.
MR. And since you mentioned also daily when you come on the job at 6:00 a.m., you check to see if the phone, cameras, everything is working?
MR. I don't have to check.
It’s - there’s no set standard or like okay you should come in and check it. You just like kind of look to see what’s going on. You kind of know what hasn’t been working and what’s been working. You kind of make a checklist for yourself. There’s no set standard of what you should do at that time. Now there is more stuff that you do. Day to day. Where before there was really no standard of okay you come in, you start, and this is the first thing you’ve got to go and do. And no. There was never anything written down as far as what should be done during your shift.
MR When did that change?

in, do you recall - I know it’s been two years. Do you recall doing a checklist? Trying to see if everything was working.
MR. I usually - because I don't get a radio in the morning. I usually first thing I do is I call for the elevator so I know the phones are working.
MR. And then I go downstairs, turn on the radio, listen to radio traffic so I know the radios are working. And as far as the camera goes, I have - that time I had like the old system that had a, I had a screen at my desk. And make sure the um -. Because it went to analog matrix. It’s going to sound a little confusing when I say analog matrix and digital matrix because the old system we had was a mixture of both. And kind of like the new system too. It takes the old analog cameras because we had a lot of old analog cameras. It takes all of that. And then it transfers it to

MR. Okay. And once it was recorded, do you remember checking the cameras that day? Seeing if it was working?
MR. I checked them later in the day. I went up to the video room. Because we were having - the thing about this whole process was when I came here, the first thing I saw was the video room. And the biggest thing was all the equipment in that room was out of date. It was old. It was - I came from another institution. Like I said before where everything kind of wasn’t modern but it was more up to date than this. And so like the camera system I had was maybe five to ten years old. And when I came here, this one was over ten years old and it was on 365 a day. Like 24 hours for the like the last 12 years. The system was always on. And something as simple as shutting down the time and change - because you got to get recording times right. When the seasons change, you would have to wait like a whole day to shut down a recorder. It takes a whole day for it to come back up after shutting it down. And where I came from, that was not the standard. Like it should be like an hour

maybe thirty minutes. Maybe even ten minutes if it’s a newer system. You shouldn’t even have that much down time as far as the recording. So one of the first things I did when I came here was I addressed that - the recorders needed to be upgraded. And -.
But like during this whole time I was doing -. I actually started the camera project and that’s why I was doing overtime around this time. And we had people come from other institutions. There was a camera project to upgrade the cameras. Everybody’s fear was the actual cameras not the recording software of the cameras. But I stated over and over again the problem you’re going to have is the recorders. And we even had the new recorders. They were in the warehouse. We have them stockpiled. They was ordered. But we were on the bottom of the list as far as install. So even though we had the new equipment, we weren’t a priority to get anything installed.

there was an error on the old software. Like I would have to physically be in the room to say hey. Because the room was upstairs on the third floor. Which I didn’t have access for. You would have to go in the room and then you go see like - because there’s a redundant drive. So you have like an A side and a B side. And say if the A side isn’t working, you have one drive goes bad. That’s not a problem. As soon as the second drive goes bad, that’s when you run into problems. And after the second drive runs into problems, that’s when you stop recording. And once that happens, you have to take the drive out, and we have to scrounge around for old drives and see if those will work. During that time I actually - prior to that I actually purchased maybe 24 drives to actually redo a whole bay - like A or the B side. I was actually going to do that.
MR. Did you know at that point that SHU cameras weren’t recording?
MR. At that point towards the end of the day I did. I believe I did know at the end of the day.

point of contact. I usually - any time I have a problem or something’s not working because I wasn’t really familiar with the whole system. I had like a newer system. It kind of worked the same, as far as the software side goes, as far like as like the hardware, it was different. So I would always have to call them for like tech support. Like okay I’m having a problem today. Can you document it? You know it builds our case when I have to submit stuff to Regional Office. Me just saying it’s not going to work, that’s not going to fly. And usually they help me troubleshoot through the whole process of what I should have to do - A, B, C, okay take this drive out, put that drive in. And like previously, probably six months before that, we actually had a mother board - which was my main computer - like go out. And I had to actually replace that and they had to walk me through it over the phone. I went to scrounge round parts from another institution

be another problem too. Okay. So there’s an A side and a B side. And it’s supposed to be redundant but it’s not redundant because it’s not really redundant when one side goes bad so it just knows to record channels. Let’s say one through 50 is on this side. And 51 through 100 is on this side. Everything is working. It doesn’t work. Okay. I can take over for this one because it’s not working. But as soon as that one goes, I can kind of record over here. As soon as the second drive goes, I have to just record what I’m recording. I can't no longer help out the other drives.

MR. The way that the doors worked at that time was - because we changed some of the cameras. But before control pops the door, they pretty much acknowledge that -. Well before - especially with 9 South. 9 South is different because the officer has the key on their hip to - there's an inner door inside here. And they won't even - well they're not supposed to - crack the outer door without somebody in SHU calling for that door. So I can't go up to 10 South - or 9 South - right now and say hey, let me get the 27 door. Somebody from SHU has to call for the 27 door. Because the inner door they have the key before you come inside of 9 South.

MR. And how did you know that?
MR. As soon as I went in I saw the drives. Because the drives, usually they’re green when everything is working and amber like when there’s an emergency or something’s wrong. And I saw that there was a few ambers. So like it wasn’t recording. Then I called SigNet, the company. And they said I have to start rebuilding. And what start rebuilding means is I have to pull that hard drive out and start putting fresh hard drives in. And then the system knows like it put a new hard drive in, it starts to sync up, and does this thing where it starts to go through. It does it all of its checks and starts recording. And that would pretty much take a day.

MR. I believe I told my supervisor.
MR. And who would have been your supervisor at the time?
MR Uh - there was really like I don't think there was nobody here.
Because we were in like the middle of a project and that was kind of chaos. So .
MR. Okay. Did you - but at that time though you knew basically all the SHU cameras were down but one.
MR.: No I didn't know anything about the SHU cameras.
MR. No-no-no. I'm talking about the SHU cameras specifically.
MR. No. I didn't - I don't know what's on the recorders. At that time I didn't know what was on the recorders. I just knew -.
MR. All right. So when you went in, you knew that some recorders - some cameras weren't recording and you didn't know which ones.

MR. So this was the end day you said so around like 2:00 p.m. you’re thinking?
MR. Um. 1:00 something.
MR. One something?

MR. All right. And then being that it happened before, was there anything that you’re supposed to do if like - hey, I’ve got to notify like the captain -.
MR. There was no -. At my old jail, I’m not trying to throw anybody under the bus but at my old jail, if anything wasn’t working and I was the contact, I couldn’t leave the jail. Like if the fence - because we had a fence system - or cameras aren’t recording. I would have to fix - stay there until okay, I need a part. This is what we’re doing. Send notification. This place is run a lot differently. And I’ve said stuff from before. And my old supervisor, but just like oh go home Daniel, don’t worry about it. And I’m like

thing about the cameras too they’re - the way the SHU cameras are they’re - the power supply is for the old analog cameras are in a - one of my closets. You would have to go in there, kill the power, and then go into mess with the recorder. Like it’s too much stuff to try to - one person to think about trying to tamper with it. It’s just a lot.

somebody messed with it. It’s not really something you go in there and start disconnecting. Like the only way to really do anything in that room is to start disconnecting stuff. And it’s a spaghetti mess.
MR. Okay.
MR. Starting to disconnect the stuff is not going to - it’s going to be tampered with, and you’ll see somebody did something.

MR. : But only SIS has it?
MR. From what I know, yes.

MR: Only SIS can get in that room.

MR: Why did you happen to go in that room that day?
MR. I don't know. I just make rounds and I do stuff. Somebody said something to me or I was thinking about it. Because I think I ordered the drive and I just wanted to see where I was at to see what I was going to get started on. And plus we were doing a camera project, so I was just trying to get a lot of things like organized and see where we were at. And what I was actually going to do.
MR. So I have to ask as part of it. Did you happen to stop doing upgrade work on it, unplug, or take down the redundancy, or anything that worked --
MR. No.
MR. -- that happened to stop working at that point?
MR. No. I just - it - because

2 MR. Mm.
3 MR. And when I say the cameras, I mean the recordings.
4 MR. When I have to do maintenance. I have to notify somebody like the cameras are going to go down. They make sure the jail is locked down and -.
5 MR. Only intentionally?
6 MR. Yes.
7 MR. They’ve never gone down -

9 MR. Oh. We’ve had um - uh - see I can’t really say that because we’ve had issues because we’re putting in IP cameras.
10 Where - the IP cameras are like little computers. And they overload the system sometimes when the software isn’t right. So it bogs down the system. And we’ve had problems where the recording stops, but we have a redundant recorder but not all the cameras would go down per se.
11 MR. Okay.
12 MR. And the reason I’m saying that also is because a lot of the cameras -

it’s like a mix and match of old cameras and new cameras - analog cameras and like more computer-based cameras - IP cameras. So right now when the system fails the old analog cameras for the most part are going to work. The problems are going to be the newer cameras on the tiers. The older cameras would always pretty much be recording. If we ever had an issue.

cameras, recordings, or hard drives or anything that were sent to try to have the recordings recovered?
MR. Uh well the whole thing with everything not recording that day was the way the system works. And we want to work with the vendor and FBI because they had to talk to - the way the system works is if the two drives are bad it’s not going to start recording video. It’s not going to go on a different drive were you’re going to see bits and pieces of video from that day. You might see old video. But as far as new video from that day, whenever it went bad, you’re not going to see any video.

drives. They took everything. They took the whole recorder - the whole recoding system. They took the next day.
MR. Because it’s pretty much you know, a computer is like one to zero. So probably when they finally get to that they couldn’t retrieve anything. Nothing like you could see or make tangible. Like no real video.

MR. Not necessarily. It could be garbage. Garbage can record and you think that’s a good thing but it is not a good thing. It says it was recording. That’s why I say that when a camera is bad or good, like I can have a camera that just looking at this and you’re saying okay it’s good but it’s not looking at the whole room. This is nothing. This is garbage. It doesn’t. The camera just knows it’s working until I fix it and then it records the whole room. Then you know it’s working.
MR. I just know the drives were bad. And I think I tried to -. Yeah because they’re like ex’d out when they’re not working. So you’re not going to see any recording files. You’ll see the live video but you won’t see anything recording.

5 MR. So was the cameras connected to a network?

8 MR. Mainly whoever had a password to look at the Nice Vision. Usually I give out the passwords or a, computer services.
9 MR. At that point who had access?
10 MR. Oh um. I think most of the lieutenants had access. The warden had access. SIS had access. I had access. And I believe computer services. And maybe a few staff members here and there. But they just looked at live video - nothing recorded or (Indiscernible *00:50:08) video.
11 MR. SO that was my next question. Could they have done anything when

they logged in to manipulate the -?
MR. No. You can't stop the -.
The newer system you can. The old system you pretty much have to go in there and manually do it. Like you can't just -. You would have to go on the recorders and -. Yeah. I don't think anybody here knew - knows how to do that.
MR. Did anyone outside the institution have access? Like because it was on the network, does like someone at the central office or anyone have access to or no?
MR. From what they told me there's no back doors to it. So.
MR. So it was a closed network?
MR. Closed. Yeah. Closed.
Yeah. In house thing.
MR. Do you know if any situations about, came up in the past where it required that someone in the central office needed to log in to see the video? And they were able to do it remotely?
MR. Nah. I don't know if the old system. The new system you can do that.

Officer was there. And I think the lieutenant at that time was -
Lieutenant when I got upstairs. Those are the officers that I remember. And then the officers that were on the unit were Officer Thomas and Officer MS. Noel. And then I just remember us saying we needed to get the stretcher from the hallway. And an AD machine. And then they took him and put him on the stretcher. And I think after a little while -

MR. And the medical guy. And then um they tried to give him the AED machine upstairs and it didn’t work. And I think the AED machine was still working on him when we took him downstairs. We were still pumping on his chest.

MR: They were - I think they were trying to cut him down and we - and I think I went to go get the stretcher and the AED so by the time I came back, whatever they were doing to try to move him --

MR. -- by the time we got the stretcher, that’s when we started working on him. Because you obviously can’t work on him because he’s hanging up and -.
MR. So you believe he was actually hanging by the time - when you got there?
MR. They were moving him down. He was in an up position and they were lowering

MR. : I usually put them down on the ground. But usually it just second nature. You always get a stretcher. Because you don't want none of the inmates seeing you work on an inmate. It never looks good. So you kind of - you just - everything is just so fast. Like it just moves just like a - it's not like you wait or hesitate. But you just kind of know what to do. There’s no hesitation. But you just know what’s going to happen and you never really want to work in front of the inmates or the inmates behind a door. Like that’s not a good idea. So you try to move them as much so you can really start working them.

maybe two days - maybe a couple days. And the thing - and I have to stress also - is just because I saw it down-. Because I don't check it every day. I don't know if it was down for a week, a month, you know. Tt’s not one of those things you check all the time. But I would - since we were having problems more readily, I would always check like once a week to make sure it was working. But before it was not like okay I’ve got to go up here and check it because it wasn’t happening.

one camera in a housing unit. When I was in Brooklyn, I was custody, it was cameras all over the place. I went to Indiana and I was a contact at a complex which was a high, medium, low, there’s a camp, there’s a death row.
There’s cameras everywhere. I come to this jail, New York City. And I’m expecting cameras everywhere. And one of the first things was like, oh, we don't have money for that. We don't have money for this. We don't have money for that. And I just kept saying hey, you guys got to do something. This is a problem. God forbid this is what happened. But I just wish there was more proactivity. Like -.

MR. And training too. Like just getting new equipment. That’s not it. Also train the staff. Because even like when I learned how to do the cameras stuff, it was just me over the phone with SigNet. I never really went to a physical training. Hey, Daniel this is the system you have. Take this drive out, do X, Y, and Z. I’m just like I’m on the phone. I’m looking at it. Okay. The light is this color. This is - I’m a smart guy. I could figure it out. But at the same time like -.
