Subject: 2020.04.23 - NOTES from call with Date: Thu, 23 Apr 2020 15:11:21 +0000 ## 2020.04.23 - NOTES from call with DOJ-OIG - Briefing IG on Monday about status and adjournment - Unlikely that they will do anything until after our trial, but if that changes, will give us a heads up - Don will call on Tuesday - DOJ-OIG ○ DOJ-OIG reports to Congress, not to AG ○ IG is head of agency ○ Divisionally, OIG is separated into components - Investigations Division (do criminal and administrative investigations; who we are working with, NY Field Office); majority is criminal, but can also handle administrative matters that stem from criminal investigations - Also handling the Epstein Report - Administrative report that arose out of criminal investigation - During criminal investigation, OIG identified numerous administrative concerns relating to conduct of other BOP employees, unrelated to and conduct - Concerns identified were failure to provide Epstein a new cellmate; Epstein’s personal call on unrecorded phone line; potentially problems with video system personal call on unrecorded phone line; potentially problems with video system ○ NOT failure to conduct counts or rounds ○ Currently, not looking into staffing issues and does not foresee doing it - is detailed to Investigations Division, usually part of Oversight and Review - These reports would typically be done by the case agent ○ Here, has had no involvement in working on report except for an initial conversation and opining on what circulated - Oversight and Review—made up of investigative attorneys; in charge of investigating matters of national importance; vast majority administrative, but also can handle criminal investigations that roll out of admin. - Evaluations and Inspections Division – administrative investigations that aren’t of national importance or high profile; very rarely, if ever, criminal investigations - Audit Division – does audits; purely administrative - Management and Planning - Fair to say no completed draft at this point - Draft will contain recommendations about BOP, which will then be discussed by DOJ-OIG; these discussions have not yet begun - Disclosure now could negatively impact future administrative investigation by DOJ-OIG on this very matter - Reviewed representations we are making in the brief—fine with them with minor changes above Assistant United States Attorney United States Attorney's Office Southern District of New York | EFTA00077057 | | :--- | :--- | This is a simple Markdown document with no headings or paragraphs.
