Pursuant to a Proffer Agreement, was interviewed at the United States Attorneys Office of the Southern District of New York, 1 St. Andrews, New York, New York. In attendance for the Proffer interview were Assistant United States Attorney (AUSA), AUSA Nicolas Roos, FBI Special Agent (SA) and Office of Inspector General SA.

After being advised of the identity of the interviewing investigators and the nature of the interview, provided information relating to the investigation.(See attached notes taken by AUSA)

- was in better, J terv, K terv, M terv, L terv now in H terv (for 3-4 weeks); was in my terv1 month, was milk close days before that, I before that

JE asked Lt. when can I leave the box, Lt. (m) said we need to keep you secure. In case piotry to extent yn.

- met eastern in 6 tier. Met when he came back from suicide watch. Did have bruise. He was in 6 tier night. Before JE left, they brought him out (JE)

-Saw him in Lt ter when took shower - his cell has next to shower.

CS6 was working and took copy of UE ID on the door took it after he died

- On August 9, was on lawyer visit, UE was speaking w/ woman attorney (black hair, light skin ), face was red+looked mad

-On the way on the elevator, CS6 told guards "you better take that man out of there or he 's going to kill himself"

→ said to Brijalva+Monge said in English

→ Their answer was "he's going to kill himself no matter what and he's got a say for what he did, he's going to kill himself any way he can put up all pressure. We don't care either way. Let him kill himself.

-CSG had heard comments that OE had tried to hang himself before.

-JE seemed desperate that lay

-Saw VE N3 times before that

-on Aug 9, fan was on. They d/n to the 10 pm count. went to sleep 3/4 am. boards d/n to count the whole time was listening to music w/ one headphone in. in 2nd cell on left hand side. can see highway from window.

- don't usually leave fan on. put fan on when inmates start making noise.

-the next morning at breakfast time there was a Lt. going out breakfast.

-guards do count around some guards to 30 min rounds, others don't.

-took system's ID thinking about money but then this situation came up.

was cleaning when took it. took it 1+1/2 wks after he died.

d/n know names of guards who don't do overnight counts. Different guards.
