Call with DW and JC — 5/30/24
- Leon Black’s counsel Susan Estrich sent letter to court in February objecting to the payment of the JPMC claim to Wigdor’s client
- Hearing 3/15 on this claim, client testified
- o Rakoff said that he was inclined to sustain the award, but wanted to have the notebooks forensically examined
- Court had the notebooks examined, they were written in gel pen and results were inconclusive as to date but no evidence found for recent fabrication
- o Examiner did not go anything as to the clippings in the notebooks
- Court then issued an order indicating that it was inclined to sustain the award, but would give Brad Edwards as plaintiffs counsel to submit a brief in opposition, which he did
- o No new arguments in the brief: principally the argument is that there’s no “corroboration” for Wigdor’s client’s claims from the other victims/ information known to BE, and the number of people she claims to be trafficked to is incredible
- The other girls could say that they knew another girl
- o Court said that it would issue an order before the end of June
- o No new arguments in the brief: principally the argument is that there’s no “corroboration” for Wigdor’s client’s claims from the other victims/ information known to BE, and the number of people she claims to be trafficked to is incredible
- Yesterday, the claims examiner who met with Wigdor’s client shared with JC that the judge called her and the judge expressed reluctance to affirm the award because he can’t understand why there is no corroboration, and he wants to meet with her on Monday
- Wigdor also wants to write to the court to get the journals back
- o : asked Wigdor not to represent that the “prosecutor” asked for the journals back
- asked what the standard is that Judge Rakoff is using to review the claim
- o Wigdor does not know, Rakoff appears to have assigned himself the right to review the claims
